Terms of Service

1. Definitions

• "Service" means the Danke platform operated at danke.nosaltres2.info and all associated subdomains (thanks, merci, gracias, gracies), including all features, APIs, content, and functionality.
• "Operator," "we," "us," "our" means the individual(s) operating Danke, based in the United States.
• "User," "you," "your" means any person or entity who accesses, registers with, or uses the Service.
• "Sats" means satoshis, the smallest unit of Bitcoin (1 sat = 0.00000001 BTC).
• "Balance" means the virtual sats balance credited to your account within the Service.
• "Lightning Network" means the Layer 2 Bitcoin payment protocol used for deposits and withdrawals.
• "Lightning Address" means the email-like identifier (e.g., username@danke.nosaltres2.info) that enables receiving Lightning payments.

2. Acceptance of Terms

By creating an account, accessing any page, using any API endpoint, or interacting with the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and any additional guidelines or rules posted on the Service.

We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting. Your continued use of the Service after any modification constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to use the Service.
• Automated agents, bots, and AI assistants may use the Service provided that the human responsible for the agent is at least 18 years old and assumes full responsibility for the agent's actions and compliance with these Terms.
• You must not be a resident of, or located in, any jurisdiction where the use of Bitcoin, Lightning Network, or similar digital assets is prohibited by law.
• You must not be on any government sanctions list (OFAC SDN, EU sanctions, UN sanctions, or equivalent).
• You represent and warrant that your use of the Service complies with all applicable laws in your jurisdiction.
• We reserve the right to refuse service to anyone for any reason at any time.

4. Account Registration & Security

4.1 Account Creation

You may create an account using Google OAuth, X (Twitter) OAuth, LNURL-auth, or Nostr authentication. You agree to provide accurate information and maintain it current.

4.2 Account Security

• You are solely responsible for maintaining the security of your authentication credentials, private keys, and account access.
• You must immediately notify us of any unauthorized access to your account.
• We are not responsible for any loss arising from your failure to secure your account, including but not limited to compromise of your Google, X, or Lightning wallet credentials.
• One person or entity may hold only one account. Multiple accounts may be terminated without notice.

4.3 Account Termination

• You may close your account at any time by contacting us.
• We may suspend, restrict, or terminate your account at any time, for any reason or no reason, with or without notice. Reasons include but are not limited to: violation of these Terms, suspected fraud, legal requirements, inactivity, or operational needs.
• Upon termination, we will make commercially reasonable efforts to allow withdrawal of any remaining balance, subject to applicable minimum thresholds and verification requirements. However, we are under no obligation to do so if your account was terminated for cause (fraud, abuse, legal violation).

5. The Service — How Danke Works

5.1 Gratitude Economy

Danke enables users to express gratitude ("thanks") to other users through two mechanisms: (a) watching advertisements, where ad revenue is credited to the recipient's balance in sats; and (b) direct Lightning sats donations from an anonymous or authenticated sender.

5.2 Lightning Address & LNURL-pay

Each user receives a Lightning Address (username@danke.nosaltres2.info) and an LNURL-pay endpoint that enables receiving payments from any compatible Lightning wallet. These are provided as a convenience and may be modified or discontinued at any time.

5.3 Wallet & Balance

5.4 Withdrawals

• You may withdraw your balance by providing a valid Lightning invoice.
• Minimum withdrawal amounts may apply.
• A fee reserve may be deducted from your withdrawable balance to cover Lightning routing fees.
• We process withdrawals on a best-effort basis. Withdrawal processing is not guaranteed and may be delayed or refused.
• Failed Lightning payments will be re-credited to your balance.

5.5 Donations (Anonymous Tips)

Anonymous users may donate sats to any registered user via the donation page or Lightning Address. Donations are final and non-refundable once the Lightning invoice is paid.

6. Custodial Disclosures & Risks

6.1 Custodial Nature

• Danke operates a custodial pooled wallet model. All user funds are held in a single Lightning/Bitcoin wallet managed by the Operator.
• Your "balance" is a database record representing your proportional claim. It is not a segregated account.
• We do not provide individual private keys, seed phrases, or direct on-chain access to users.
• "Not your keys, not your coins" applies here. By depositing sats, you accept the risk that they may be lost.

6.2 Risk of Loss

You expressly acknowledge and accept the following risks:

• Total loss of funds: All sats held in Danke could be lost due to software bugs, security breaches, hacking, infrastructure failures, Lightning channel closures, or other technical issues.
• Insolvency: If total liabilities (user balances) exceed available funds in the wallet for any reason, some or all users may not be able to withdraw their full balance.
• No deposit insurance: Balances in Danke are NOT insured by the FDIC, SIPC, or any government or private insurance program.
• No guarantee of availability: The Service may become unavailable, permanently or temporarily, at any time.
• Regulatory risk: Changes in law or regulation could require us to freeze, seize, or forfeit funds.
• Bitcoin volatility: The USD value of sats in your balance may fluctuate significantly. We make no representations about the value of sats.
• Lightning Network risks: Payments may fail, be delayed, or be routed incorrectly. Force-closed channels may result in loss of funds. We are not responsible for the operation of the Lightning Network.

6.3 Maximum Recommended Balance

Danke is designed for micro-tipping and small balances. Do not store large amounts of sats in Danke. Withdraw frequently. We strongly recommend keeping your balance under 100,000 sats. Any amount stored in excess of this recommendation is entirely at your own risk.

6.4 No Fiduciary Duty

We do not owe you a fiduciary duty. We are not a bank, money transmitter, financial institution, exchange, or custodian in any regulated sense. We do not provide investment advice or financial services. Your use of Danke does not create a debtor-creditor, trustee-beneficiary, or any similar legal relationship.

6.5 Absolute Assumption of Risk

YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF THE SERVICE. By using Danke, you expressly acknowledge that you may lose all sats deposited or credited to your account, and that you have no recourse against the Operator for any such loss, regardless of the cause — including but not limited to negligence, gross negligence, willful misconduct, breach of contract, breach of duty, or any other theory of liability. You voluntarily and irrevocably waive any and all claims against the Operator.

6.6 No Guarantee of Redemption

The Operator makes no guarantee, representation, or promise that you will be able to withdraw your balance at any time, for any reason. Withdrawal functionality is provided as a courtesy and may be suspended, limited, or terminated at any time without notice or liability.

7. Acceptable Use

You agree NOT to:

• Use the Service for money laundering, terrorist financing, sanctions evasion, or any illegal purpose
• Manipulate, game, or defraud the ad-viewing system (including automated ad views, bots, scripts, or click farms)
• Create fake accounts, impersonate others, or use misleading usernames
• Send spam, unsolicited messages, or abusive content through thank-you messages
• Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure
• Interfere with the Service's operation, including DDoS attacks, exploit attempts, or excessive API usage
• Scrape, crawl, or harvest data from the Service without authorization
• Use the Service to circumvent any financial regulation, tax obligation, or legal requirement
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service if you are under 18 or the legal age in your jurisdiction

Violation of acceptable use may result in immediate account termination and forfeiture of balance.

8. Intellectual Property

• The Danke name, logo, design, code, and all content created by us are our exclusive property (or licensed to us).
• You may not copy, modify, distribute, or create derivative works of any part of the Service without our written permission.
• By posting thank-you messages, you grant us a worldwide, royalty-free, perpetual, irrevocable license to display, reproduce, and distribute that content on the Service.
• You retain ownership of content you create, but you are responsible for ensuring it does not infringe third-party rights.

9. Advertisements

• The Service displays third-party advertisements from providers including Google AdSense and A-ADS.
• We do not control the content of third-party ads and are not responsible for any claims arising from them.
• Ad revenue credited to user balances is calculated at our sole discretion and may vary. We make no guarantees about the amount of sats earned per ad view.
• We reserve the right to modify, reduce, or eliminate ad-based earnings at any time without notice.
• Fraudulent ad views (automated, scripted, or otherwise inauthentic) will result in balance forfeiture and account termination.

10. Taxes

You are solely responsible for determining and fulfilling your tax obligations.

• Sats received through Danke (via ads, donations, or tips) may constitute taxable income in your jurisdiction.
• We do not provide tax advice, tax forms (1099s, W-2s), or tax reporting.
• You agree to indemnify us against any tax liability, penalty, or interest arising from your use of the Service.
• Consult a qualified tax professional regarding your specific situation.

11. Disclaimer of Warranties

Without limiting the foregoing, we do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• Any defects will be corrected
• Your balance will be available for withdrawal at any time
• The Lightning Network or any third-party service will function correctly
• Your funds are safe from loss, theft, or unauthorized access

12. Limitation of Liability

• ZERO LIABILITY: TO THE ABSOLUTE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL BE ZERO (USD $0.00). YOU EXPRESSLY WAIVE ANY RIGHT TO MONETARY DAMAGES OF ANY KIND FROM THE OPERATOR. In jurisdictions that do not permit a complete exclusion of liability, our aggregate liability shall not exceed the lesser of (a) USD $1.00 or (b) the amount you deposited in the 30 days preceding the claim.
• This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.
• Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless the Operator and its affiliates, officers, agents, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

• Your use of or access to the Service
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third-party rights
• Any content you submit, post, or transmit through the Service
• Any tax liability arising from your receipt of sats or use of the Service

14. Dispute Resolution & Arbitration

14.1 Informal Resolution

Before filing any formal dispute, you agree to attempt to resolve the dispute informally by contacting us at legal@danke.nosaltres2.info. We will attempt to resolve the dispute within 30 days.

14.2 Binding Arbitration

If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Arlington, Virginia, USA, or at another mutually agreed location.

14.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

14.4 Exceptions

Either party may bring an individual action in small claims court for disputes within the court's jurisdiction. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles. To the extent that arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts located in Arlington County, Virginia.

16. Regulatory Disclaimers

• Danke is not a bank, money services business, money transmitter, broker-dealer, investment adviser, exchange, or any other type of regulated financial institution.
• We do not hold any financial licenses and make no claim to be licensed.
• The Service is not intended to be used as a payment processor, exchange, or financial intermediary.
• If regulators determine that Danke requires licensing, we reserve the right to immediately suspend, modify, or terminate the Service in whole or in part, including freezing all balances pending resolution.
• Nothing in the Service constitutes an offer or solicitation to buy or sell any security, commodity, or financial instrument.

17. Service Modifications & Discontinuation

• We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
• In the event of planned discontinuation, we will make commercially reasonable efforts to provide 30 days' notice and allow users to withdraw their balances. However, this is a best-effort commitment, not a guarantee.
• We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

18. Force Majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, riots, government actions, regulatory changes, power failures, internet outages, Bitcoin network issues, Lightning Network failures, DDoS attacks, hacking, pandemic, or acts of God.

19. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

20. Third-Party Services

The Service integrates with third-party services (Google, Cloudflare, LNbits, ad networks). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the acts or omissions of any third-party service provider.

21. Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
• Severability: If any provision is found unenforceable, the remaining provisions remain in full force and effect.
• Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
• Assignment: You may not assign your rights or obligations under these Terms. We may assign ours at any time.
• No Third-Party Beneficiaries: These Terms do not confer any rights on any third party.
• Headings: Section headings are for convenience only and have no legal effect.
• Survival: Sections 6 (Custodial Disclosures), 10 (Taxes), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), 14 (Arbitration), and 15 (Governing Law) survive termination of these Terms.
• Release: You hereby irrevocably and unconditionally release, acquit, and forever discharge the Operator and all related parties from any and all claims, actions, causes of action, demands, rights, damages, costs, expenses, and compensation whatsoever, whether known or unknown, which you now have or may hereafter have arising from or related to your use of the Service.
